Attempted Murder by the Deliberate Cultivation of Meningitis

On the 23/04/1993 my late wife Liz underwent spinal surgery in the private Ross Hall Hospital, Glasgow, Scotland.

The purpose of that procedure was to remove a protrusion on the right side of the L5/S1 disc, a protrusion identified earlier by M.R.I. scan, a protrusion thought to be responsible for the acute lower back and leg pain that Liz was suffering from at that time.

Liz had done her homework regarding the preferred surgeon but at the last moment, for family reasons,he pulled out and recommended that Liz use a surgeon whom he assured her was more than capable, Liz thought it over and then agreed, the biggest mistake of her life.

At some point in that procedure, almost certainly when carrying out the process of Fenestration (the process of removing backbone by means of fragmentation) the operating surgeon, Consultant Orthopaedic Surgeon, Mr James Hugh Hay, (now apparently deceased) drove several (at least eight) fragments of backbone into Liz’s Dural membrane (the membrane which houses the spinal cord) resulting in extensive Dural damage, copious Cerebrospinal Fluid (CSF) leakage, in short, horrific operational carnage.

At that point Hay would have no idea of the extent of that operational carnage. He wouldn’t know for example if he had damaged Liz’s spinal cord (at that point he hadn’t), he wouldn’t know if Liz would ever walk again (she did), he wouldn’t know if she would still have control of her lower body functions (she did). The extent of that damage could only be established once the anaesthetic had worn off, by which time of course it would be too late for Hay to deny or conceal that horrific operational carnage,
Hay wasn’t having that.

To conceal that hellish operational carnage Hay assisted by a Dr Tatek (Orthopaedic Surgeon) a Dr Donald Macgregor Brown (Anaesthetist) and Ross Hall Management then attempted to murder Liz by cultivating within her body a meningococcal infection.

Every postoperative action, every instruction increased the risk of Meningitis and had those instructions been carried out to the letter, had Liz been showered as Hay specifically instructed the nursing staff to do so, then that shower would almost certainly have proved fatal.

When Liz was returned to her room from theatre at 8.25 pm, by which time Messrs Hay, Tatek and Brown had fled Ross Hall, leaving Liz in the care of the nursing staff, a Redivac Suction Drain, already filling with Cerebrospinal Fluid was taped to her back and a tube ran down from that drain entering her body via an open wound at the base of her spine.

At that point Liz was lying on her left side, covering her mouth was an oxygen mask into which she had vomited. She was crying and screaming “ God help me, please God help me”

I immediately asked to speak with Hay only to be told that he was a police surgeon and had been called to an emergency. An absolute lie, I was told the following day that Hay, Tatek and Brown were seen running from Ross Hall an hour before Liz was returned to her room.

I then asked to speak with Hospital management only to told by one of the nurses that at that time on a Friday evening all the management had gone home, more lies.

To explain my wife’s condition I was told by a nurse that Liz was suffering from a bad anesthetic reaction and that when the anesthetic wore off Liz would be fine, again more lies

I stayed with Liz until 11.30 pm by which time Liz was in in a much more peaceful state. I was then told by the nursing staff that my presence was preventing them from doing their job properly and so very reluctantly I left Ross Hall Hospital.

Immediately after my departure, on Hay’s instructions and absolutely clinically inexplicable, Liz was put in a side sitting position propped up by pillows, the suction drain draining CSF from her Cranio Sacral System and so the attempt to murder my wife had begun.

Overnight on Hay’s instructions Liz was nursed in a completely inappropriate position, in a side sitting position, propped up by pillows, as CSF was deliberately and systematically drained from her Craniosacral System via the suction drain and tube taped to her back, all the time subjecting her to horrific pain and suffering and all the time increasing the risks of Heart Failure, Stroke and Meningitis.

Heart Failure…. Giving what was happening in other parts of her body the strain placed upon her heart would have made heart failure a distinct possibility.

Stroke…. Cerebrospinal Fluid is produced by the brain and the pressure put upon Liz’s brain to produce Cerebrospinal Fluid as Cerebrospinal Fluid was being deliberately drained from her Craniosacrial System via the suction drain and tube taped to her back, would have been horrific.

Meningitis…. It is a clinical fact that if fluid can get out then bacteria can get in and by the clinically inexplicable use of a suction drain and tube in the presence of a CSF leak, lHay made certain that spinal fluid could get out and that therefore bacteria. including meningococcal bacteria. could get in.,

On at least two occasions that night, on the night of Friday 23/04/1993, Liz, in sheer desperation threw the pillows supporting her on to the floor and collapsed face down onto the bed burying her head deep into the mattress. She didn’t know it at the time but instinctively she had found the one position that would bring her some relief from the deliberate and criminal drainage of CSF from her craniosacral system.

As she lay there, as the upper body pain, the nausea and the blinding headache eased, as her head cleared a little, Liz became aware of something dribbling from her back, it was CSF of course but she didn’t know that, what she did deduce however was that she must have an open wound in her back. As she continued to lie there, as her head cleared even more, Liz slowly came to the realisation that she had been butchered and that she would need to be careful, be on her guard.

At some point that night two nurses entered the room, they replaced the pillows, returned Liz to a side sitting position and immediately those hellish side effects returned. Liz told the nurses that she felt much better lying flat but the nurses told her that they had been instructed by Mr Hay to nurse her in an upright position, that her body had to be supported at all times. As soon as the nurses had left the room, Liz once again threw the pillows to the floor, once again collapsed face down onto the bed and by doing so almost certainly saved her own life.

At approximately 6.30 am next morning, Liz having been once again returned to a side sitting position, propped up by pillows, Cerebrospinal Fluid still being drained from her craniosacral system via the suction drain and tube taped to her back, Liz in considerable pain and discomfort but not as bad as she would have been had she not spent at least half the night lying flat on her stomach, greatly reducing the hellish side effects of deliberate and systematic CSF drainage, a Dr Donald Brown (Anaesthetist involved in the earlier procedure ) entered her room.

Dr Brown then sat on the bedside chair and began talking to Liz, he told her that he was attending a conference of Anaesthetists in Peebles Hydro that weekend and that by the time he got back to Glasgow from Peebles, she would be gone. Dr Brown then took my wife’s hands in his and said to her “You poor thing, you poor poor thing, this has nothing to do with me, this is not my fault but Jimmy (James Hay) and I go back a long way”. Dr Brown then got up and left the room.

When Dr Brown was talking to Liz that morning, I firmly believe that he thought that he was talking to a patient who had been nursed all night in a side sitting position propped up by pillows, CSF being drained from her body throughout the night, reducing her to an almost coma like state, almost certainly unable to comprehend what he was saying to her.

Dr Brown had no idea that Liz had spent most of the night lying flat on her stomach, he didn’t know that Liz heard, understood and memorised every word spoken to her that morning.

When Dr Brown told Liz that by the time he got back from Peebles that she would be gone, he didn’t simply mean that she would have left Ross Hall (impossible in her condition), he meant that she would be dead. When he said to Liz “you poor thing, you poor poor thing, this has nothing to do with me this is not my fault, but Jimmy and I go back a long way” he said that because he knew that Liz was to die a particularly horrible death from a meningococcal infection, that meningococcal infection deliberately cultivated by the abuse of her CSF leak by Hay ,Tatek, Brown and Ross Hall Management.

Dr Brown, just like the others involved in this matter seriously underestimated the intelligence and determination of my beautiful and courageous wife.

The first attempt to shower Liz was made shortly after Dr Brown’s departure, at 7.00 am that morning, on the morning of Saturday 24/04/1993. Even in the hellish state she was in (and how much worse would that state have been if she hadn’t thrown the pillows from the bed and lay flat), Liz knew that a shower made no sense and that because of the open wound in her back (an open wound she only became aware of when she threw the pillows from the bed and lay flat) would increase the risk of infection and so refused to be showered.

When two nurses, wearing waterproofs, tried to physically remove her from the bed to take her into the en suite shower, having at that point made no attempt whatsoever to remove the suction drain and tube and seal the wound, Liz prevented them from doing so by clinging to the side rails of the bed. Liz clung to those side rails as if her life depended on it and of course it almost certainly did.    

Eventually Liz placated the two nurses by telling them that they could shower her when I arrived.

I arrived at 8.30am to find Liz in a hellish state, once again being nursed (for want of a better word) in a side sitting position propped up by pillows, Cerebrospinal Fluid still being drained from her body via the suction drain and tube still taped to her back. As I sat there, holding her hands, not having a clue at that point as to what was going on but doing my best to reassure her, Liz, after two failed attempts managed to whisper to me “Don’t let them shower me, I’ll get infected”. At that point, as I say, I had no idea what was going on(none of the nurses would answer my questions telling me that Mr Hay would answer those questions, I didn’t see Hay until the following Wednesday) but to further reassure Liz I promised her that there would be no shower.

Moments later two nurses entered the room, they were wearing waterproofs over their uniforms, plastic bootees over their shoes and carrying shower caps. One of the nurses asked me to leave the room, telling me that Liz was to be showered.
I replied by telling the two nurses that under no circumstances would Liz be showered. The nurse in charge then told me that she had been specifically instructed by Mr Hay to shower Liz and that Mr Hay would not be happy if those instructions were not carried out.

I then made it perfectly clear to the two nurses that regardless of Mr Hay’s instructions or indeed his happiness, there would be no shower.

The two nurses had a whispered conversation and then left the room.

At some point that morning Mr Hay telephoned Ross Hall and spoke to the duty nurse on my wife’s ward, the same nurse that I spoke to later that day. He asked the duty nurse one question about Liz, only one question, and that question was “Has Mrs McCay been showered?”

He had butchered her the evening before, driving numerous fragments of back bone into her Dural membrane resulting in horrific operational carnage. Overnight he had her nursed in a clinically inexplicable position, in a side sitting position propped up by pillows, as CSF was deliberately and systematically drained from her craniosacral system via the suction drain and tube taped to her back, all the time subjecting her to horrific pain and suffering and all the time increasing the risks of Heart Failure, Stroke and Meningitis, and next morning his only concern about her was if she had been showered, indicating just how important that shower was to him.

The effect of that shower, just like the effect of any shower would have been to wash all kinds of bacteria including meningococcal bacteria down Liz’s body. The effect of the tube running down into Liz’s body via the open wound at the base of her spine, (an open wound behind which CSF was leaking from a torn and mutilated Dural membrane) would have been to channel some of that waterborne bacteria, including meningococcal bacteria inside Liz’s body.

Meningococcal bacteria coming into contact with blood and/or CSF would then have led to a meningococcal infection of one kind or another and almost certainly Liz’s death. That of course was the objective of Messrs Hay, Tatek, Brown and Ross Hall Management, to murder Liz in a way that could be accidently explained and by doing so concealing Hay’s horrific operational carnage forever.

If anyone has any doubts about the effect of a shower in the circumstances that I have just described, circumstances that are a matter of fact, a matter of record, (nursing notes), circumstances witnessed by others, then let them do as I did and talk to the experts at The Meningococcal Research Centre, Stobhill Hospital, Glasgow. 

If those experts are as honest and as forthright today as their predecessor the late Dr Leslie Smart was with me in January 1995 then those doubts will soon be removed.

Later that same day about 4.00pm on Saturday 24/04/1993, Liz still being nursed (?) in a side sitting position propped up by pillows, CSF still being drained from her Craniosacral system via the suction drain and tube still taped to her back, Liz in agony, crying out with pain, every nurse involved in that horrific postoperative abuse decided to switch sides with regard to the attempted murder of my wife, every nurse signed a statement condemning that abuse, handed that statement to Ross Hall management asking them to intervene.

Ross Hall management did not intervene and so that murderous abuse continued. Not only did Ross Hall management not intervene they actually ordered the nursing staff to obey Mr Hay’s instructions in this matter “to the letter”. In other words, Ross Hall management ordered the nursing staff to continue with that murderous post operative abuse.

At 2.00 pm on Sunday the 25/04/1993, Liz still being nursed(?) in a side sitting position, by this time every last drop of CSF having been drained from her body via the suction drain and tube still taped to her back, Liz now in a coma like state, a Dr R. J. (RMO on duty that weekend) who had I believe by that time exhausted every level of management within Ross Hall in her attempts to bring that murderous abuse to an end, but with no success, brought an outsider, a senior medical professional into Ross Hall hospital. This senior medical professional ( someone who obviously outranked Hay) spent a few minutes at Liz’s bedside and then said “This has gone far enough”.

 I have no idea what then transpired between the senior medical professional and the others involved in this matter but soon after his visit the suction drain and tube were removed, the wound sealed, the pillows removed, Liz laid flat and finally after some forty-four hours that horrific murderous abuse was brought to an end.

The day after that abuse was brought to an end on Monday the 26/04/1993 Hay gave instructions to the nursing staff that Liz be sedated that night, the only night she was sedated.
At 11.35 pm that night, Liz drowsy but not asleep was suddenly aware of a presence in her darkened room, she was terrified but too weak to do anything.
At that moment the door was opened, the light switched on and a nurse entered, standing at Liz’s bedside was Mr Hay.

The nurse challenged Hay asking him if he had signed in as was the procedure.(He hadn’t). Hay ran at the nurse, pushed past her and continued running, Hay left Ross Hall that night as he had entered, via a fire door situated at the bottom of the staircase which separates the Lomond and Argyll wards.

Having failed to murder Liz by cultivating a meningococcal infection within her body or indeed by inducing Heart Failure or Stroke I believe that Hay’s intention that night was to murder Liz by more direct means.

That was why she was sedated, so that there would be little or no resistance, so that she might be more easily murdered. Hay knew that if Liz lived, as she did, that the intradural bone fragments would be found, as they were, and that they would lead back to him as they should have done years ago, as they would have done years ago had Police, Procurator Fiscal’s Service and Crown Office acted with integrity in this matter.

When the instruction was given to the nursing staff that Liz be sedated on the night of Monday  26/04/1993 I know for a fact that the nurses suspected that they might get a visitor that night (a nurse told me so next morning) and so were watching over Liz like hawks, checking on her every two minutes or so.

One nurse actually took a chair from the reception area and placed it in a position where she could sit there and keep an eye on the door to my wife’s room.

This suggests to me that perhaps this wasn’t the first time that Hay had instructed that a certain patient be sedated, that certain patient tragically found dead next morning. I now know for a fact that Hay had a history of poor spinal surgery and I don’t believe that my Liz was the first patient that he butchered and then attempted to murder or did indeed murder.
If anyone has lost a loved one following surgery carried out by Consultant Orthopedic Surgeon Mr James Hugh Hay either in Ross Hall Hospital Glasgow or in the Royal Alexandria Hospital Paisley then they should attempt to have that death properly investigated, although given initially Strathclyde Police and later Police Scotland’s downright refusal to properly investigate my allegations in this matter then perhaps those deaths will never be properly investigated.

One more fact about this particular episode, a very important fact, fire doors don’t open from the outside, that night someone inside Ross Hall opened the fire door to allow Hay unseen access to Liz’s room.

It is my considered opinion that the person who opened the fire door allowing Hay unseen access to my wife’s room was the same person who lied to me throughout this matter, the same person who refused to bring that murderous postoperative abuse of my late wife to an end when asked to do so by other medical professionals, the same person who lied under oath at the GMC Hearing in London in March 2002.
That person was Mrs Mary Rankine of Ross Hall Management.

Hay’s nocturnal visit to Ross Hall approaching midnight on Monday 26/04/1993 where I believe his intention was to murder my wife to conceal his horrific operational carnage was pre planned by both Hay and Rankine, one as guilty as the other.

Next day I instructed Ross Hall management to remove Hay and replace him with a competent surgeon, and after a somewhat heated exchange, they agreed to do so.

Eventually I brought Liz home from Ross Hall both of us completely unaware of those intradural fragments of back bone. By allowing Liz to leave Ross Hall with those bone fragments inside her Dural membrane, the Dural membrane healing around them and concealing them, Messrs Hay, Tatek, Brown and Ross Hall Management were responsible for every second of agony, anguish and absolute terror that Liz experienced in those last hellish five years of her life.

I won’t go in to all the details as time and time again another surgeon sought to find and remove those intradural bone fragments, suffice to say that when those bone fragments cut into her spinal cord and or nerve root ends, her screams could be heard on the other side of town.

On one occasion that pain was so brutal, so vicious, so unbearable that I witnessed Liz regress into childhood, actually become a little girl crying for her Mummy as she desperately tried to escape that pain.

On the 20/04/1998, almost exactly five years to the day of her hellish experience in Ross Hall, my beloved wife Liz collapsed and died from a Stroke in our home in Lanark.

Despite their best efforts, Hay, Takek, Brown and Ross Hall management failed to murder Liz in Ross Hall hospital in April 1993, but let no one be in any doubt that they were ultimately responsible for her untimely death.

I have fought this matter in Edinburgh where Hay admitted Medical Negligence.

I have fought this matter at the General Medical Council ( A criminal and corrupt organization in my opinion) headquarters in London where following a weeklong hearing in March 2002, Hay was found guilty of Serious Professional Misconduct.

Medical Negligence and Serious Professional Misconduct relating to the (mis)treatment of a CSF leak, carried out by a Consultant Orthopaedic Surgeon is an attempt to cultivate Meningitis.

Not to understand the truth of that statement is to understand nothing, absolutely nothing about the risk of Meningitis in the presence of a CSF leak. There is an inherent risk of Meningitis in the presence of a CSF leak and the only reason that medical professionals would abuse a CSF leak as Messrs Hay, Tatek, Brown and Ross Hall management abused my late wife’s CSF leak would be to further increase that inherent risk of Meningitis.

I have in my possession the bone fragments in question, as they were returned to me by The Pathology Department of Edinburgh University where they were analysed and found to be without exception, fragments of Lamellar bone (back bone), the same bone that would be removed during the process of Fenestration.

 I also have in my possession MRI scans taken prior to every procedure that Liz endured between April 1993 and March 1996, five in total. These scans have also been analysed and that analysis clearly shows that during that period only one process of Fenestration was carried out, that that process of Fenestration was grossly excessive and that that process of Fenestration was carried out in April 1993, leaving no doubt, no doubt whatsoever that Mr James Hay and only Mr James Hay could have been responsible for those fragments of backbone becoming intradural. 

It is a clinical fact that any mistreatment of a CSF leak increases the risk of Meningitis and for forty- four hours my late wife’s CSF leak was deliberately and systematically abused, that abuse a matter of fact a matter of record, ( nursing notes), that abuse carried out despite the protests of other medical professionals, that abuse eventually and only brought to an end by the intervention of those medical professionals.

I don’t believe for one second however that it was ever the intention of Messrs Hay, Tatek, Brown and Ross Hall management to abuse my late wife’s CSF leak for such a prolonged period of time, that only happened when their initial attempt to murder my wife was thwarted when Liz refused to be showered.
Had the first attempt to shower Liz been successful (@7am) then I believe that by the time I arrived (@8.30am) that the suction drain and tube, having served its hellish function, having channelled all kinds of waterborne bacteria including meningococcal bacteria inside Liz’s body would have been long gone, no doubt to become a figment of my imagination.

The wound would have been sealed, pillows removed, Liz laid flat, and then perhaps the foot of the bed slightly elevated to better facilitate the flow of bacteria ridden CSF from its starting point at the base of Liz’s spine to her brain.

Messrs Hay, Tatek, Brown and Ross Hall Management would then have sat back and waited for the meningococcal bacteria washed into Liz’s body by the shower to do their dirty work for them. Then of course it would just have been one of those terrible tragic accidents that one reads about from to time, death from a postoperative infection. “Terribly sorry, Mr McCay, terribly, terribly sorry, we did everything we could but the infection spread so quickly, terribly sorry”.

Can’t you just hear them?

When the suction drain and tube were taped to Liz’ back (Clinically inexplicable both in use and position) the decision to murder her had already been taken and the method by which she would be murdered (Meningitis) had already been chosen.
Meningitis was chosen because of the inherent risk of Meningitis in the presence of a CSF leak but had Liz died of Heart Failure or Stroke, the risk of both greatly increased by that postoperative abuse, it would have made no difference to Messrs Hay, Tatek, Brown  nor indeed Ross Hall Management, just so long as Liz died and Mr Hay’s horrific operational carnage died with her.

With the possible exception of the nursing staff, all who were present in the operating theatre when the suction drain and tube were taped to Liz’s back were party to the decision that she was to be murdered by the cultivation of Meningitis in order to conceal Mr Hay’s horrific operational carnage.

In Scotland the criminality in this matter extends far beyond the Medical Profession. In Scotland the criminality in this matter extends to Police, Procurator Fiscal’s Service, Crown Office and indeed The Scottish Government itself.

I first made these allegations known to the relevant authorities in May 1998 one month after Liz’s death.  For more than twenty years I’ve been told time and time again by the above organisations that there is no criminality involved in this matter, that the surgeon simply didn’t know how to treat a CSF leak and quite frankly I find that assessment to be as ludicrous as it is corrupt, as nonsensical as it is criminal and as unjust as it is wrong.

Almost everything that happened to Liz in Ross Hall Hospital in April 1993 was criminal.

When the fragments of back bone were driven into her Dural membrane, resulting in horrific operational carnage, that was criminal, criminally negligent, and everything that happened thereafter as they tried to murder her by the cultivation of Meningitis in order to conceal that horrific operational carnage, was also of course very much criminal.

In this matter I use the word criminal advisedly, there is a medical fact, a longstanding medical fact, a medical fact older than myself, a medical fact which states that if the treatment of a Cererbrospinal Fluid leak is not clinical then because of the risk of Meningitis, that treatment is criminal.

In this matter I would defy anyone including The Royal College of Surgeons to provide a clinical explanation for the postoperative treatment of my late wife’s CSF leak in Ross Hall hospital in April 1993 at the hands of Mr James Hugh Hay and others.

In actual fact the criminality in this matter extends beyond Scotland, the criminality in this matter extends to the General Medical Council in London.

I first made these allegations known to the General Medical Council shortly after my wife’s death in April 1998 by sending them a full and detailed account of the horrific operational carnage and the attempts to murder my wife by the deliberate cultivation of meningitis in order to conceal that horrific operational  carnage.

In due course I received a reply from the General Medical Council telling me that a hearing/ trial would be held into this matter, that the General Medical Council  would organize everything and that they would meet all costs and keep me updated at all times.

At the end of the letter they recommended that I use the services of a certain London legal firm whom, they assured me, were well versed in Medical Negligence and also in English Criminal Law, under which the hearing would be held.

Thinking ( perhaps rather naively) that the General Medical Council would be impartial in this matter, I wrote back and accepted.

The General Medical Council then sent my papers to a Professor C.B. a Professor of Orthopedic Surgery asking him to compile a report on this matter.

When Professor B received my papers they were in such disarray that it took him more than an hour to get them into order and with hindsight I don’t believe for one second that that disarray was accidental.

Professor CB eventually compiled his report, a report which was absolutely damning of Mr Hay, a report which actually surprised me with its honesty, integrity and its clarity.

When submitting his report to the GMC, a copy also sent to me, Professor CB informed them that he would be available to attend a hearing any time  during 2001 except August when he had a prior commitment.

After three hearing cancellations ( through no fault of mine) the GMC then set a new hearing date and that new date was August 2001, thereby removing Professor CB.

With Professor B. removed ( deliberately in my opinion) then a new Medical Expert had to be found and funnily enough my lawyers in London, the same lawyers recommended to me by the General Medical Council and almost certainly working in collusion with the General Medical Council, knew the very man, a Dr G.

When I read Dr Gs report on this matter, a report almost complimentary of Mr Hay and so absolutely different from Professor B’s report I naturally became suspicious, worse was to follow.

A week before the hearing was due to begin, in late July 2001 I received a phone call from my London Solicitor informing me that she was looking forward to meeting me in London the following week and that everything was well prepared, and that she was confident of a good outcome at the upcoming hearing/ trial. She then went on to tell me, almost as an aside that the fragments of backbone had been removed as evidence from the hearing.

I immediately enquired as to why the bone fragments had been removed,when the bone fragments had been removed and who had removed them.
After some hesitation she then told me that a sub committee of the GMC had removed the bone fragments and that they had been removed in November 2000. She then went on to tell me that the bone fragments had been removed by the sub committee of the GMC because they couldn’t be absolutely certain that Mr Hay was responsible for the fragments of backbone becoming intradural.

I replied by reminding her that only Hay had performed the process of Fenestration ( the removal of backbone by means of fragmentation)and that therefore only Hay could have been responsible for those fragments of backbone becoming Intradural.

The bone fragments ( in my opinion the most vital evidence in this matter) had been removed in November 2000 and I was only informed of this in July 2001, a week or so before the hearing was scheduled to take place in Aug 2001.
The removal of the bone fragments as evidence by the GMC sub committee was I believe a criminal act.
The failure of my lawyers, those lawyers recommended to me by the GMC, to inform me of their removal in November 2000, or as soon as they knew, was also in my opinion a criminal act.

On the morning of the hearing I met with my lawyer in The General Medical Council’s headquarters in London where the Hearing/ Trial was scheduled to take place and immediately sacked her telling her that she wasn’t working for me, that she was in fact working to the instructions of the General Medical Council.
I then informed the QC sitting beside the lawyer, also a lady, that she couldn’t represent me in this hearing as she had not been properly prepared by my ex lawyer.

I then entered the court room and for three days I argued for a postponement of the hearing on the grounds that I had been lied to, misled and deceived by a firm of London solicitors, that firm of London solicitors recommended to me by the General Medical Council.

I continued by informing the packed courtroom that the General Medical Council had removed an expert medical witness ( Professor B) because they feared his honesty, and tried to replace him with someone I considered to be a yes man for The General Medical Council. I also informed the assembled courtroom that the General Medical Council had criminally removed vital evidence ( bone fragments) to assist Hay’s defense.

I then told the assembled courtroom that what was intended in this courtroom was not a proper trial of Mr James Hay but a circus, a circus organized by the General Medical Council, a circus in which I was to be the clown.
I then made it quite clear to the assembled courtroom that I was nobodies clown and if I didn’t get Justice in that courtroom then I would get Justice on the streets of Glasgow.

After three days of argument and debate between myself and the QC for the defense ( I argued and the QC debated) I was granted that postponement, the Chairwoman of the jury telling me to “Go back to Scotland Mr McCay and find lawyers that you can trust, and only return here when you’re ready to do so”

The Chairwoman then went on to say that she too had for some time been concerned about the relationship between the General Medical Council and those firms of London solicitors who represented the victims and their families, the same firms of London Solicitors time and time and time again.

Lawyers work for those who pay them and some lawyers, just like dogs, never bite the hands that feed them.

What I took part in at the General Medical Council Headquarters in August 2001 was I believe utterly criminal, an absolute travesty of Justice, a set up by the General Medical Council to assist Hay’s defense and that of course raises the question, over the years just how many hearings/ trials have been “set up” by the General Medical Council ?

The relationship between The General Medical Council and those certain London Solicitors should I believe be subject to a criminal investigation.

I returned to London in March 2002, accompanied by a Scottish solicitor, a Scottish QC and importantly with Professor B, once again however the bone fragments were removed as evidence.

The bone fragments were removed as evidence by the General Medical Council so as to allow Hay to lie about extent of Dural damage. Under cross examination Hay admitted damaging my wife’s Dural membrane but only to a degree of 1mm.

When one considers that eight fragments of backbone were removed from inside my wife’s Dural membrane ( three ventrally/ five dorsally) some of those fragments 2cm long and some of those fragments not less than 1/2 cm wide, then the idea that they entered my wife’s Dural membrane via a 1mm tear is of course absolute and utter nonsense. I believe that the Dural damage was even greater than the scale of Fenestration and that of course was grossly excessive. That fact could not be established however because of the ( illegal in my opinion) removal of bone fragments from the hearing by the General Medical Council.

In actual fact I don’t believe for one second that Hay could have driven at least eight fragments of backbone into my late wife’s Dural membrane accidentally, one fragment perhaps, maybe two, but eight, absolutely impossible.
I believe that Hay after driving one, perhaps two fragments of backbone into my late wife’s Dural membrane accidentally, then unable to cope with the ensuing operational carnage almost immediately decided to murder Liz in order to conceal that horrific operational carnage by cultivating a meningococcal infection within her body.

I then believe that Hay drove the remainder of those bone fragments into my wife’s Dural membrane deliberately so as to greatly increase the scale of Dural membrane damage, so as to greatly increase the outflow of Cerebrospinal Fluid, so as to greatly increase the risk of meningitis because as I say the decision to murder Liz had already been taken.

Eight fragments of backbone were found and removed from inside my wife’s Dural membrane but not one fragment of backbone was ever found outside my wife’s Dural membrane and I have to say that I find that absolutely strange in a very sinister way.

As stated earlier Hay had a history of poor spinal surgery and I believe that even today that history should be subject to criminal investigation. I also believe that my late wife was not the first patient that Hay attempted to murder or did in fact actually murder.

When giving evidence Professor B stated that a normal CSF leak was a cataclysmic experience for the patient and one couldn’t even begin to calculate just how much that cataclysmic experience had been multiplied in my late wife’s case by the clinically inexplicable use of a suction drain.

For some forty four hours my late wife didn’t suffer from Cerebrospinal Fluid leakage, she suffered from deliberate and systematic Cerebrospinal Fluid drainage, that in itself an act of heinous criminality carried out by Hay, Tatek, Brown and Ross Hall Management.

Professor B then went on to state that the post operative treatment of my late wife’s CSF leak most certainly increased the risk of Heart Failure, Stroke and in particular Meningitis, the only medical professional to publicly declare those facts.

Also appearing at the second hearing was the ubiquitous Dr G. this time for the defence.

Dr G answered all the questions put to him by my QC on this matter in such a relaxed and comfortable manner that I couldn’t help thinking just how much at home he looked, so much at home in fact that later that day I asked one of the doormen ( a fellow Scot) if he had seen Dr G at the GMC H/Q before. “Him” he replied  rather scornfully,  “He’s never away from the place”.

Dr G was I believe an Professional Apologist for the Medical Profession, someone who had taken part in numerous GMC hearings, sometimes appearing for the defense, sometimes for the prosecution, but every time working in collusion with the General Medical Council.
It would be interesting to know just how many General Medical Council hearings Dr G. was involved in, very interesting indeed.

As stated earlier I believe that The General Medical Council removed Professor B from the first hearing because they feared his honesty and attempted to replace him with Dr G, their own place man.
Obviously they couldn’t remove Professors B from the second hearing but it would appear that they still had to have their man Dr G. in place and so they brought him in to bolster Hay’s defense.

The relationship between Dr G and the General Medical Council and the number of times Dr G appeared as a witness at General Medical Council hearings should I believe be subject to criminal investigation.

We are told that all General Medical Council Hearings are conducted under English Criminal Law, don’t believe a word of it, General Medical Council Hearings are conducted under General Medical Council Law, and if needed General Medical Council criminality, make no mistake.

Hay was eventually fund guilty of Serious Professional Misconduct when in fact he should have been found guilty of attempted murder or indeed murder in a proper Court of Law and not the circus that is a General Medicine Council hearing.

The General Medical Council state that they exist to protect patients and to guide doctors, don’t believe a word of it, certainly not in this case, in my experience they are indeed a corrupt and criminal organization.

In his defence in this mattered Hay stated that he had never before experienced a CSF leak, and was therefore unsure as how to treat my late wife’s CSF leak, and I have to say that I find that explanation completely unbelievable and utterly unacceptable.

According to my records Hay had carried out over one hundred and twenty spinal procedures before butchering my wife, and according to a proper spinal neurosurgeon “Hay didn’t understand spinal surgery, hadn’t done a lot of it ( in comparison with the neurosurgeon) and what he had done it would appear he hadn’t done it very well”.
For Hay to have carried out more than one hundred and twenty spinal procedures, procedures that he didn’t understand, procedures that he hadn’t done very well and not to have experienced a CSF leak is quite simply, unbelievable.

For one reason or another 4% of all spinal procedures result in a CSF leak, which means that if Hay was good enough to be an average spinal surgeon then he would have experienced a minimum of five (almost certainly more ) CSF leaks before he butchered my late wife.

Because of the inherent risk of Meningitis, the correct treatment of a CSF leak, whilst extremely important, is also extremely simple, so simple in fact that not even a junior doctor never mind an experienced Consultant Orthopaedic Surgeon, assisted by other senior medical professiopnals and Ross Hall management, could get it wrong.

Patient position and careful observation are all that’s required to properly treat a Cerebrospinal Fluid leak
In the correct treatment of a CSF leak the patient does absolutely nothing and the surgeon does virtually nothing, as I say quite impossible to get wrong.

Following the failure of Messrs Hay, Tatek, Brown and Ross Hall Management to murder my wife in Ross Hall Hospital in April 1993 she suffered three further CSF leaks as another surgeon sought to find and remove those intradural bone fragments. No surgeon, no matter how skilful can remove intradural bone fragments without creating a CSF leak.

During those CSF leaks, all of them treated perfectly and so differently from the original I asked that surgeon every question that could be asked about CSF leaks, about the cause, effects, treatment and dangers of CSF leaks.

Today, thanks to that surgeon and my own observations I know as much as any layman does about the correct and proper treatment of a CSF leak and today, perversely, thanks to Mr James Hay and my own observations I know as much as any layman does about the abuse of a CSF leak.

Let me state one more time.

There is an inherent risk of Meningitis in the presence of a CSF leak and the only reason that medical professionals would abuse a CSF leak as Messrs Hay, Tatek, Brown and Ross Hall Management  abused my late wife’s CSF leak would be to further  increase that inherent risk of Meningitis

As stated above by Professor B the post operative mistreatment of my late wife’s CSF leak increased the risk of Heart Failure, Stroke and in particular Meningitis.

Does anyone actually believe that Mr James Hay, a Consultant Orthopedic Surgeon assisted by other senior medical professionals and Ross Hall Management and despite the protests ( written and vocal) of other medical professionals could increase the risk of Heart Failure, Stroke and in particular Meningitis over a forty four hour period accidentally?

No, neither do I.

No one has to tell me just how serious my allegations are in this matter but let no one be in any doubt that I will stand by those allegations in any courtroom in Scotland or indeed England.

The institutional criminality in this matter is absolutely staggering, from the city of Glasgow,to Edinburgh, to London, institutional criminality every step of the way.

During his career Mr James Hay was a Police Surgeon, a Crown Office Expert Medical Witness and doctor to the Scottish Rugby Union Team and no doubt a Freemason, (In Scotland no one gets to the first three aforementioned positions if they’re not a Freemason) perhaps four good reasons as to why there has been such unbelievable institutional criminality in this matter.
In Scotland it would appear that if one has a certain type of handshake then one can get away with murder.

Those who would protect Hay, Tatek, Brown and Ross Hall Management in this matter are in my opinion lower forms of life than the meningococcal bacteria used by them in their post operative attempt to murder my wife.

Meningococcal bacteria doesn’t know what it is, doesn’t know what it does, doesn’t know why it does it, but those who would protect Hay, Tatek, Brown and Ross Hall Management in this matter, whether by their lies, their silence or by their deliberate failure to do their duty, they know who they are, they know what they’re doing and they know why they’re doing it.

With regard to this matter, those responsible for Justice in Scotland and indeed in England should hang their heads in shame.

We first met at 8 pm on the last Friday of November 1969 in a bar in South Kensington, London. I was standing at the bar buying a round of drinks and when I turned to take the drinks back to my mates, Liz was standing with a group of friends in the middle of the bar room, as I walked past I literally couldn’t take my eyes off her, and funnily enough as I was looking at her, she was looking at me, only for a second, but in that second I knew my race was run.

I took the drinks back to my  mates, placed the tray on the table, picked up my drink and said to my mates “I may be gone some time”.

I then walked over to Liz and said to her “ Can I tell you something “. “Of course” she replied in a surprisingly beautiful Scottish accent. (I say surprisingly because she looked like a perfect English rose, tall, slender, fair haired and beautiful) I then said to her “If you’re in a relationship it’s finished.” She laughed and said “Do you think so?” I then said “ No I don’t think so, I know so, and so do you” .

She stopped laughing.

That night I walked her home and then I continued to walk her home every night for nigh on thirty years.
Actually Liz told me soon after that she was in a relationship at that time with a guy back in Scotland but that relationship ended just after 8pm  on the last Friday of November 1969 in a bar in South Kensington, London.

We then met almost every evening, walking and talking on the streets of London, sometimes having a meal, sometimes having a drink but mostly just walking and talking and falling in love.

We started walking and talking on the streets of London, but over the years we walked and talked on the streets of Paris, Rome and so many of the beautiful cities of Europe and beyond. Not for us the hills and glens however, we were I have to say most definitely street walkers.

One evening about two or three weeks after meeting as we walked and talked she suddenly stopped, turned to me and said. “Secret” I leaned across and kissed her and then said “Tell me your secret”.
She then said “ That night we met, I noticed you as you went to the bar, when you were standing at the bar with your back to me, I was looking at the back of your head willing you to turn and see me, and you did”.  I laughed, kissed her again and then we walked on.

“Over the next thirty years Liz told me hundreds of her secrets, always when out walking and talking and always preceded by a kiss.

On the evening of Saturday April 18th 1998 as we walked and talked in the garden of our home in the town of Lanark in central Scotland, Liz’s right arm tucked into my left arm, a walking stick in her left hand, I told her that I would be singing that night.

“Oh no”she said, is it Elvis?” “No I replied it’s Pavarotti, Amour te Vieta has been in my head all day, I have to get it out”.

“My God, she said, in that case I’m going upstairs, to the attic.” We laughed and continued walking, then she stopped turned to me and said “Secret”. I looked at her quizzically,leaned across and said as I had said so many times in our years together “ Tell me your secret” She looked at me even more quizzically and then said “No kiss, no secret”. I laughed, kissed her and once again said “ Tell me your secret”

She laid her stick against my jacket, reached up and grasped the collar of my big jacket and said. “ I love your singing, when I hear you singing I feel so safe and secure “, and then she added “ I mean who would come near our house hearing a noise like that”. We laughed and continued walking, little did I know that as we walked talked in our garden that evening that she had told me her last secret, she collapsed and died two days later.

I wrote this after her death.

Long years have passed since first we walked and talked our words of endless love, on London’s streets on winter nights, with air served chilled and gulped in bites as heaven’s eyes shone bright above.

Stars don’t twinkle, they blink in disbelief when faced with greater earthly light, was I the only one who knew, those eyes of heaven they blinked at you.

Those nights we walked those nights we talked when only heaven’s eyes could see, on London’s streets, the three of us, just you and love and me.

Betrayed by man of medicine, of orthopedic creed, by one who ripped, who tore, who broke, who cut and ran but before he ran he sewed within the seeds, those seeds of shame so deep within.

To hide those seeds, protect his name, your life had to end, Hay set the stage then called from hell his meningococcal friend

Was that his one and only time to act with heart so cold, you clung to life but always knew that death was set on hold.

Then five long years of hellish pain, of tears and fears and desperate nights, when death came stalking around our home, we hid you from him, out of sight.

Then I would talk away your fears  and I would kiss away your tears, brave love held death at bay those years, then dark gave way to light.

By Lanark’s loch we walked again, slower now you still in pain, we stopped we kissed in Autumn rain, we walked we stopped we kissed again, by rainswept loch only God could see, the three of us, you, love and me.

One day as love and I relaxed as Spring began her bursting through, death crept in unseen unheard, he passed us by went straight to you and in that second we knew, we knew.

We ran though never heard you cry, arrived in time to see you die and as you took your final breath, with love I tried to kill your death

Then I cursed at God above but worse than that I cursed at love, a love so weak it would give way, allowing death his final say.

Once more I kissed your tears though wondered why the dead would cry, you didn’t weep, those tears were loves, they simply fell from eye to eye.

Those years we fought death night and day we fought it to the end, God how things change and rearrange now I’d see it as a friend.

Deaths just a gate that separates, one day we’ll vault it clear and when we do we’ll search for you and we will find you never fear.

Sweet love will guide me straight and true through Heaven’s maze my Liz  to you, just to see your face again, free of tears, of fears, of pain.

At night we’ll walk on Heaven’s streets, see Heaven’ eyes beneath our feet, we’ll walk and talk just as in life, a trinity, love, man and wife, we’ll walk our walk and talk our talk of words of endless love.
